1. Acceptance of Orders & Purchase Orders requests
1.1 All Business transacted between Customers and prospective Customers and Parker Bell shall be bound by these conditions. Any other conditions as suggested by Parker Bell or the Customer can only be enforced if agreed to in writing by both parties.
1.2 Orders placed with Parker Bell will fulfilled subject to availability. Parker Bell will contact you as soon as possible if there is to be any problem with fulfilling your order.
1.3 All orders & equipment will remain the property of Parker Bell until they are paid for in full.
2.1 All orders will be charged at the advertised price for the goods when placing your order unless agreed otherwise.
2.2 Prices are subject to change without notice
2.3 Prices are quoted do not include VAT which is charged at the current legislated rate.
3.1 Delivery will be made to the address stated on the order form unless specified otherwise in writing.
3.2 Dates and times quoted for delivery are given only in good faith and do not constitute part of the agreement. Parker Bell will not be liable for loss or damage due to failure to deliver at a stated time or day.
3.3 Customers may cancel the goods at anytime up to 7 days after the receipt of the goods. Customers must return the goods in perfect condition within 7 days of receiving them for a full refund. Unwanted goods must be returned at the expense of the customer.
3.4 Claims for incorrect or non-delivery of items must be made in writing to Parker Bell within 10 working days of the receipt of the goods, accompanied by the original packaging note for incorrectly delivered goods and within ten working days of the covering invoices for non delivery. All claims covering the operability of the goods will be covered by the manufacturing guarantee. See Section 7 on these terms and conditions.
3.5 Damage in transit must be notified to Parker Bell within 3 days of receipt and the original packaging should be returned.
3.6 Delivery charges will be as specified on the website, however are subject to change. Customers will be notified at the point of order of any changes prior to despatch.
3.7 Parker Bell reserve the right to refuse to accept claims that are not received at the sellers offices within the times or under the conditions set out above.
4.1 Payment is required prior to the goods being despatched unless expressly agreed.
4.2 Invoice payments will be requested in UK pounds sterling (GBP) free of any deductions or bank charges.
4.3 Parker Bell reserve the right to charge interest at 2% per month compounded monthly on all sums not paid when due.
4.4 Parker Bell reserve the right to charge an administration charge in respect of each invoice not paid writhing 14 days of it's due date. The current charge is £100. Reviewed annually.
4.5 If money is owed to Parker Bell on several accounts we may allocate money received to any such account not withstanding any suggested allocation by the Customer.
5.1 Parker Bell will refund customers in full provided they contact Parker Bell and return the good as new writing 7 days of receipt. Customers are fully responsible for the cost of returning the goods as well as for any loss or damage.
5.2 The money back guarantee is not available for Customers who have had items specifically made for them. Please contact us for separate negotiation.
5.3 When refunding items Parker Bell may retain the cost of the delivery of items.
5.4 When refunding items Parker Bell may retain the cost relating to any damage of loss of items or accessories.
5.5 Parker Bell may charge an administrative fee if a Customer has not adhered to the process detailed above.
6. Property in Goods
6.1 Notwithstanding risk having passed, title in goods shall not pass until payment has been made and received by Parker Bell in full.
6.2 Parker Bell reserve the right to retain or recover all goods in which we have title and shall have the right to enter upon the Customers or any other premises where we can reasonably believe the goods to be situated for that purpose and the Customer will indemnify us for all costs, claims and expenses arising.
7. Description & Warranty
7.1 Goods are supplied with a 12 months warranty against defects in workmanship or materials
7.2 Warranty extensions may be purchased separately after calibration only. See section 8.
7.3 Initial warranties and extended warranties shall not apply unless:
a) The Customer notifies Parker Bell immediately of any matter which may give rise to a claim. Or
b) The customer keeps the goods in the same condition as when he became aware of the said matter and deals with it thereafter only as directed by us.
7.4 Where a valid claim is made against the warranty Parker Bell will be liable for the repair or replacement of the goods. Parker Bell will be in no way liable to the Customer or any third party for loss or damage caused by the defect nor for any consequential loss however caused.
7.5 Where inspected goods are found to be in working order or if defects are caused by misuse, the Customer may be charged a handling fee.
7.6 In the case of resale, Customers may pass on the benefit of the remainder of the warranty for the remainder of the warranty period. The Customer must notify us in writing the details of the change of ownership for the items for the warranty to be valid.
8.1 Charges for calibration as well as associated courier costs are as detailed on the website. Parker Bell reserve the right to amend these charges without notice.
8.2 Parker Bell and their Courier will not be liable for damage or loss of items which have not been packed securely and addressed clearly.
9.Use of Website
9.1 This website, any content contained herein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law.
9.2 Parker Bell makes every effort to ensure that this site is free from viruses or defects. We shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
9.3 The images used on our website are used for illustration only. While products supplied are usually as illustrated, it may be necessary to supply a comparable product in some instances.
The failure or delay on our part in enforcing any of our rights hereunder shall not be construed as a waiver of those rights, which shall remain fully enforceable.
These conditions and all dealing will be governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. This shall apply for all orders places by telephone, in person, e-mail, fax, letter or via our website irrespective of the country of residence of the buyer.
These terms and conditions do not affect your legal rights.
